1. Agreement
By accessing or using any website, app, podcast feed, media, or free tool we operate (collectively, the “Sites”), you agree to these Terms of Use (the “Terms”). If you do not agree, do not use the Sites.
These Terms are a generic baseline for Sites associated with Steve Simonson and related brands. Additional product-specific terms may apply where stated on a particular Site.
2. Who we are
The Sites are operated by Steve Simonson and/or entities or brands he controls or represents (for example Awesomers, Parsimony, and other projects as listed on each Site). “We,” “us,” and “our” refer to those operators for the Site you are visiting.
This site: Awesomers Podcast hub — awesomers.com.
3. Informational use only
Content on the Sites—including podcasts, articles, tools, catalogs, comments, and downloads—is provided for general information and educational purposes only. It is not legal, tax, medical, investment, accounting, or other professional advice. You are solely responsible for decisions you make based on the Sites.
4. No guarantee of results
Any examples of results, revenue, traffic, rankings, or business outcomes are illustrative or historical. We do not guarantee any particular outcome. Past performance is not a promise of future results.
5. Intellectual property
Unless otherwise noted, Site content (text, branding, logos, audio, video, graphics, software, and layout) is owned by us or our licensors and protected by applicable intellectual property laws. You may not copy, scrape, republish, sell, or exploit Site content for commercial use without prior written permission, except for personal, non-commercial viewing and ordinary sharing of public links or embeds we provide.
Podcast and media files may be offered for personal listening/viewing; redistribution or rehosting without permission is prohibited.
6. Acceptable use
You agree not to:
- Use the Sites in any unlawful way or for fraudulent or harmful purposes
- Attempt to gain unauthorized access to systems, accounts, or data
- Interfere with or disrupt the Sites, servers, or networks
- Scrape or harvest content or data in bulk without our written consent
- Misrepresent your identity or affiliation
- Upload malware or abusive content where submission features exist
We may suspend or block access for abuse or risk to the Sites or other users.
7. User submissions
If you submit content (comments, forms, feedback, or other materials), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content as needed to operate and improve the Sites. You represent that you have the rights to submit it and that it does not violate law or third-party rights.
8. Third-party links, products, and ads
The Sites may link to third parties, marketplaces, tools, or partners. We are not responsible for third-party sites, products, policies, or practices. Purchases or interactions with third parties are solely between you and them. Affiliate or advertising relationships may exist where disclosed.
9. Free tools and utilities
Interactive tools (for example counters, catalogs, or calculators) are provided as-is. Output may be incomplete, outdated, or incorrect. Always verify critical data against official sources (for example marketplace seller tools or primary documentation).
10. Privacy
Our collection and use of information is described in the Privacy notice. By using the Sites you also acknowledge that notice.
11. Disclaimer of warranties
The Sites and all content and services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Sites will be uninterrupted, secure, or error-free.
12. Limitation of liability
To the maximum extent permitted by law, we and our affiliates, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Sites. Our total liability for any claim arising out of the Sites will not exceed one hundred U.S. dollars (US $100) or the amount you paid us (if any) for the specific service giving rise to the claim in the twelve months before the claim, whichever is greater.
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.
13. Indemnity
You agree to defend and indemnify us against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Sites, your content, or your violation of these Terms or applicable law.
14. Changes
We may update these Terms at any time by posting a revised version on the Site. The “Last updated” date will change when we do. Continued use after changes constitutes acceptance of the revised Terms.
15. Termination
We may stop providing all or part of a Site, or restrict your access, at any time. Provisions that by nature should survive (including IP, disclaimers, liability limits, and indemnity) will survive termination.
16. Governing law
These Terms are governed by the laws of the United States and the state or jurisdiction in which the operator primarily conducts business, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue for disputes, except where prohibited by law.
